Obama, Congress and Syria

It’s a potent sign of how low the American political bar is set that gratitude is expressed because a U.S. president says he will ask Congress to vote before he starts bombing another country that is not attacking or threatening the U.S. That the U.S. will not become involved in foreign wars of choice without the consent of the American people through their representatives Congress is a central mandate of the U.S. Constitution, not some enlightened, progressive innovation of the 21st century. George Bush, of course, sought Congressional approval for the war in Iraq (though he did so only once it was clear that Congress would grant it: I vividly remember watching then-Senate Foreign Relations Chairman Joe Biden practically begging the Bush White House to “allow” Congress to vote on the attack while promising in advance that they would approve for it). But what makes the celebratory reaction to yesterday’s announcement particularly odd is that the Congressional vote which Obama said he would seek appears, in his mind, to have no binding force at all. There is no reason to believe that a Congressional rejection of the war’s authorization would constrain Obama in any way, other than perhaps politically. DoD Training Manual Suggests ‘Extremist’ Founding Fathers ‘Would Not Be Welcome in Today’s Military’

Obama’s Willing Executioners of the Fourth Amendment

Edward Snowden’s heroic revelations have made it possible for some House members from both parties to blow away the fog that shrouds so much tap dancing on Capitol Hill. When the Amash amendment went to the floor, there was no place left to hide. To their historic shame, 134 Republicans and 83 Democrats voted against Amash’s amendment (while 94 Republicans and 111 Democrats voted for it). That’s how the measure lost, 217-205. The record of the House vote tells us a lot. Top Republicans – including Speaker John Boehner, Majority Leader Eric Cantor and Majority Whip Kevin McCarthy – voted with Obama policies to keep smothering the Fourth Amendment. So did top Democrats, including Minority Leader Nancy Pelosi and Minority Whip Steny Hoyer. The stench at the pinnacle of GOP power hardly surprises most Democrats. Constitution Read to House of Representatives, Only 74 Members Show Up

In the midst of the Obama administration’s ongoing efforts to eviscerate the Second Amendment by executive order, it was extremely telling that so few members of the House took the time to show their respect for the Constitution. The document was divided into 120 sections, with GOP House leaders believing that at least that many members would show up to each read a section. When all was said and done, however, only 74 members attended. Today’s liberty-minded youth are not like this. They embrace individual liberty – and loathe the collective. The America That Was is Now the United (Police) State of America

The seeds of destruction were already sown at the very beginning – with the Alien and Sedition Acts being perhaps the first highly visible step in the wrong direction. Then came the forceful assertion of one national government, with states reduced to administrative regions via the War of Southern Secession, from 1861-’65. I’m no fan of state governments, incidentally, but at least they’re smaller and closer to their subjects than the federal government. Another major step in the wrong direction occurred with the Spanish-American War of 1898, where the US acquired an overseas empire by force. The next major step downhill was the creation of the Federal Reserve and the income tax, both in 1913, just in time for World War I. Squealing Versus Killing

The president is evading federal law on the use of the military by having the now-paramilitary CIA kill people in foreign countries with drones and disrupt a foreign population with a cyber-war. And he is violating the Constitution and federal law by starting wars on his own. But the loudest and most sanctimonious of politicians are not demanding that the president follow the Constitution and the laws he has sworn to uphold. Rather, they are demanding to know who told the media about the president’s war making. How Ron Paul Could Win

The Bill of Rights is No More

While most Americans were celebrating the holidays, President Barack Obama quietly signed the National Defense Authorization Act (NDAA), otherwise known as the “Indefinite Detention Act,” into law. Obama had initially said he would veto the bill which contains the draconian language authorizing the US military to seize and incarcerate US citizens without warrant, due process, trial, etc. Of course, Obama quickly changed his mind after the bill passed both houses of Congress. When signing the NDAA into law, Obama issued a signing statement that in essence said, “I have the power to detain Americans… but I won’t.” Americans should realize that, coupled with the Patriot Act, the NDAA, for all intents and purposes, completely nullifies a good portion of the Bill of Rights, turns the United States into a war zone, and places US citizens under military rule. Neo-cons like Levin, Sean Hannity, and Rush Limbaugh who now fancy themselves as constitutionalists since there is a Democrat in the White House are hypocrites of the first order. Most of them gave me that look of stupidity that younger folks like to give my generation. Since most of them are younger than me, I'm sure they were never taught anything about the U.S. Constitution. God help us.

Here in fogy-fascist Cape Coral, FL, they used to fly helicopters over my neighborhood at 2-3 am in the morning at very low altitude. I don't know if I was the target, but I suspect they were using gee-whiz technology to find miscreants growing marijuana on their lanais. This "wake the dead" activity in a town where they will put you in jail for 6 months for listening to music with a window open at noon on a Saturday--unless you are a bar that has made the necessary payments. Scrape the crud off the bottom of society's septic tank, give it a badge, a gun, a uniform, and a license to kill, and what do you think will happen? With the recent Indiana Supreme court ruling giving police unfettered access to people’s homes, Newton county Sheriff Donald Hartman Sr. believes the ruling makes house to house searches possible. Indiana Court: No Right to Resist Illegal Cop Entry Into Home

Overturning a common law dating back to the English Magna Carta of 1215, the Indiana Supreme Court ruled Thursday that Hoosiers have no right to resist unlawful police entry into their homes. On Real Respect for the Constitution

Appeals Court: Email Is Protected Under the Fourth Amendment

An appeals court ruling that may reduce the sentencing for Steve Warshak, the head of a company who was convicted of fraud and other crimes as part of his business to sell “male enhancement” pills, also contained a powerful little nugget that brings the Fourth Amendment of the U.S Constitution into the digital age.

The ruling (PDF) found that the government’s seizure of some 27,000 private e-mails, obtained without search warrant from Warshak’s Internet service provider as part of the government’s investigation, was a violation of the Fourth Amendment, which protects against illegal searches and seizures. In this particular case, however, the court agreed with the government that its agents “relied in good faith on the Stored Communications Act” and that a reversal of the conviction was unwarranted based on the violation.

Obama Argues His Assassination Program is a ‘State Secret’

At this point, I didn’t believe it was possible, but the Obama administration has just reached an all-new low in its abysmal civil liberties record. In response to the lawsuit filed by Anwar Awlaki’s father asking a court to enjoin the President from assassinating his son, a U.S. citizen, without any due process, the administration late last night, according to The Washington Post, filed a brief asking the court to dismiss the lawsuit without hearing the merits of the claims. That’s not surprising: both the Bush and Obama administrations have repeatedly insisted that their secret conduct is legal but nonetheless urge courts not to even rule on its legality. Does Anyone Read the Constitution?

Does anyone read the U.S. Constitution these days? American lawyers don’t read it. Federal Judge Susan R. Bolton apparently has never read it. Same goes for our illustrious Attorney General Eric Holder. But this lawyer has read it and she is going to show you something in Our which is as plain as the nose on your face.

Article III, Sec. 2, clause 2 says:

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction…

“Original” jurisdiction means the power to conduct the “trial” of the case (as opposed to hearing an appeal from the judgment of a lower court). You all know quite well what a “trial” is – you see them all the time on TV shows: Perry Mason, Boston Legal, The Good Wife, etc. Witnesses testify and are cross-examined, etc.

State political leaders should keep 'Nullification' in mind as this federal government no doubt becomes even more tyrannical in the future. If the federal government threatens to withhold federal funding to any State exercising its rights, than that State should have its citizens withhold federal taxes. The issue isn't just unconstitutional laws at the federal level, but as in the case of Arizona especially, it is the federal government simply refusing to do its duty under the constitution. A State may initially feel the pain of federal funding being withheld for highways and education for instance, but it would also give that particular State the opportunity to actually gain financial independence from the crooks in Washington, which in the long term would be better for the States. Nullifigation would either push the Feds into doing what they should, if not, States would gain greater independence. It's a win win situation.

Supreme Court Extends Gun Rights Nationwide

The Supreme Court held Monday that Americans have the right to own a gun for self-defense anywhere they live, advancing a recent trend by the John Roberts-led bench to embrace gun rights.

Nevada Joins Fight Against Obamacare

CARSON CITY, Nev. – Gov. Jim Gibbons says Nevada has officially joined at least 18 other states in a lawsuit challenging the federal health reform law.

In a statement Friday, the first-term Republican governor says an amended lawsuit adding Nevada as a plaintiff was filed Friday in Florida.

Gibbons has been an outspoken critic of the law signed in March by President Barack Obama. He and others claim it is unconstitutional because it would force people to buy health insurance or face penalties imposed by the Internal Revenue Service. He also says it would increase Nevada’s Medicaid costs by $575 million.

FBI Raids Funeral Service to Arrest Militia Members

The FBI conducted raids Saturday night in Washtenaw County and Lenawee County in an investigation involving members of Hutaree, a Christian-oriented militia group based in Lenawee County, AnnArbor.com has learned.

Once again, this sort of behavior on the part of police inclines me, as a prospective juror to simply vote "not guilty" in the trial of anyone accused of killing any police officer, for any reason. If police want the community on their side, they need to cut this crap out.

I was horrified and sickened when I saw this picture on the Post-Gazette's website the day of the shooting. This cop should be stripped of his badge immediately. He was holding a rifle with one hand, finger on the trigger. Any little distraction or mishap and he would have put a bullet through this woman. Imagine if he had simply sneezed or slipped on a rock.
